FAQ From the Call Center
 

Q:

During 2004, I engaged in a covered call position that has since expired with the short call not being exercised. For tax purposes, is the premium received from the sale of the call considered short-term or long-term capital gain?
 

A:

Please be advised that OCC does not assume any responsibility as tax professionals and that all tax related question are best answered by a CPA or your brokerage firm. For your specific scenario our Taxes and Investing Guide states: "Premium received from writing a call is not included in income at the time of receipt, but it is held in suspense until the writer's obligation to deliver the underlying stock expires. If the writer's obligation expires, the premium is short-term capital gain to the writer upon expiration REGARDLESS of the length of time the call is outstanding."
